Our readers might be already familiar with Fictitious Business Name filings – we had previous blog entries about the subject before. What we haven’t specifically addressed are Los Angeles Fictitious Business Name renewals (commonly referred to as DBA, or “Doing Business As”). This is a popular choice for some of our customers, who are just starting a business: a DBA filing is quick and pretty inexpensive, but there are some drawbacks; the main one being that it does not provide a limited personal liability like a corporation or a LLC.
But wait, there is more (and that’s the subject of today’s blog). Unlike a corporation or a LLC, DBAs expire automatically after five years from the filing, unless renewed in a timely manner.
A little fact that might not be known is that a renewal does not require a publication – as long as the renewal happens in the 40 days preceding the expiration of the five years validity AND there are no changes in fact in the filing (changes are considered a new registrant joining the business, or a different address).
We routinely contact our customers a couple of months before the five years are over, to let them know of the looming deadline. When it comes to Fictitious Business Names, renewing early = saving money.
